These Terms of Sale & Service govern purchases from DRKD ("DRKD," "we," "us," or "our").

By placing an order, you agree to these Terms.

1. Products

DRKD currently offers the Retreat 32, Retreat 189, and Retreat 21.

Current pricing and specifications are shown on each product page and at checkout. Product availability, pricing, and specifications may change without notice. We try to display product information accurately, but errors may occur.

2. Pricing and payment

Prices are listed in U.S. dollars unless otherwise shown at checkout. If your order is placed from outside the United States, your bank or card issuer may apply currency conversion or foreign transaction fees.

Payments are processed through Shopify Checkout and Shopify's payment providers. DRKD does not intentionally collect or store full payment card numbers.

Sales tax, duties, and other applicable charges may be calculated and displayed at checkout.

3. Order acceptance

Submitting an order does not guarantee acceptance. We may refuse or cancel an order for reasons including:

• Suspected fraud
• Product unavailability
• Incorrect pricing
• Incorrect product information
• Payment issues
• Shipping restrictions
• Legal or compliance reasons

If we cancel an order after payment has been collected, we will issue a refund.

4. Shipping

Shipping is governed by our Shipping Policy, which is incorporated into these Terms.

DRKD ships within the United States. The Retreat 189 also ships to select international destinations shown at checkout; our other products ship within the United States only at this time.

Standard shipping is free on all orders. No expedited shipping option is offered.

For international orders, duties, import taxes, and customs fees are the responsibility of the recipient and are not included in the product price. Customers are responsible for confirming that the product may lawfully be imported into their country.

Delivery dates are not guaranteed. Shipping times may vary based on product availability, destination, carrier performance, customs processing, weather, holidays, and other factors outside our control.

5. Returns and refunds

Returns and refunds are governed by our Return & Refund Policy, which is incorporated into these Terms.

In general:

• Returns are accepted within 30 days of delivery
• Products must be returned in unused, like-new condition with original packaging and accessories
• Customers pay return shipping for change-of-mind returns
• No shipping charge is collected, so none applies to refunds
• DRKD pays return shipping for defective, incorrect, or damaged items
• Return shipping costs vary significantly by product and destination; contact us before returning any large item or international order

6. Warranty

DRKD products include a 1-year limited warranty against defects in materials and workmanship under normal use, as set out in our Warranty Policy.

If a product is defective during the warranty period, DRKD may, at its discretion:

• Repair the product
• Replace the product
• Provide a refund

The warranty does not cover misuse, abuse, accidents, unauthorized modifications, improper handling, normal wear, cosmetic wear, or damage caused by failure to follow instructions.

7. Product use and safety

Use DRKD products only as directed.

Do not stare directly into LEDs. Discontinue use if discomfort occurs.

Consult a qualified healthcare professional before use if you have photosensitivity, epilepsy or seizure disorder, light-triggered symptoms, eye conditions, or if you take photosensitizing medications.

DRKD products are not a substitute for professional medical advice, diagnosis, or treatment. Individual experiences may vary.

8. Limitation of liability

To the fullest extent permitted by law, DRKD will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your purchase or use of our products.

To the fullest extent permitted by law, DRKD's total liability for any claim related to a product or order will not exceed the amount you paid for that product.

Nothing in these Terms limits liability that cannot legally be limited.

9. Force majeure

We are not responsible for delays or failure to perform caused by events outside our reasonable control, including carrier delays, customs delays, natural disasters, supply chain disruptions, labor disruptions, government actions, internet outages, or payment processor issues.

10. Changes to these Terms

We may update these Terms from time to time. The version in effect at the time of your order will apply to that order.
